Terms of Service

Version: 1.0.0

Effective date: 25 August 2026

1. Operator and agreement

TheLevel4.app is operated by Marius Frieder Hertel, a sole proprietor with Bolivian tax number/NIT 705179046, at Eudoro Galindo 1972, 6A, 00000 Cochabamba, Bolivia. TheLevel4.app is a product and platform name and is not a separate legal entity.

These Terms govern use of the TheLevel4.app website, web application, Android application, account, learning content, exercises, AI-supported feedback, credits, and related support services. By creating or using an account and accepting the active version, the user enters an agreement with Marius Frieder Hertel for use of the service.

Purchases are separate payment transactions with the applicable provider. Paddle is the seller and Merchant of Record for web purchases. Android purchases are processed through Google Play under its applicable transaction terms. These Terms govern the TheLevel4.app service and service-side entitlements.

2. Eligibility

A user must be at least 18 years old and legally able to enter this agreement. The current service is offered to individual consumers and individual aviation professionals. It is not currently offered under enterprise, airline, school, instructor, team-seat, or institutional terms.

A user must provide accurate account information, select the correct country, use an account only for themselves, and keep credentials secure. A user must promptly notify contact@innocate.me of suspected unauthorized access.

3. Aviation-training scope and safety

TheLevel4.app provides independent aviation-English education, practice exercises, simulated communications, transcription, and AI-supported feedback. It is not affiliated with, approved by, or a substitute for ICAO, a civil aviation authority, an air navigation service provider, an airline, an approved language-testing body, or an accredited training organization unless expressly stated in a separate written agreement.

The service does not conduct an official ICAO language proficiency examination, issue a licence endorsement, certify operational competence, or guarantee any examination, licensing, employment, or safety outcome.

Do not use or rely on TheLevel4.app during a live flight, air traffic control operation, emergency, abnormal operation, accident, incident, dispatch decision, maintenance action, or other real-world operational activity. Official regulations, clearances, instructions, charts, manuals, standard operating procedures, checklists, training requirements, and qualified human judgment always prevail.

4. AI, transcription, and scores

The service may use Google Cloud Speech-to-Text, configurable OpenAI Whisper transcription, and Google Vertex AI or Gemini to transcribe speech and generate practice evaluations, scores, explanations, and feedback.

Transcripts and AI outputs may be incomplete, delayed, inconsistent, or wrong. Accent, audio quality, background noise, device limitations, network conditions, exercise context, provider availability, and model behavior can affect results. A score or feedback item is educational guidance, not an official determination.

TheLevel4.app does not use voice recordings to create biometric voiceprints or identify speakers. AI-supported results do not make decisions producing legal or similarly significant effects.

5. Accounts and authentication

Each individual may maintain only the accounts reasonably permitted by the service. A user must not share an account, sell access, impersonate another person, use another person's transaction, or bypass identity, country, plan, credit, integrity, or security controls.

Authentication and account infrastructure use Firebase services. The user is responsible for access to the registered email account and for completing required verification. We may require reauthentication or proportionate verification before sensitive account, billing, privacy, or deletion actions.

6. Country availability

Service and purchase availability varies by country and may change because of payment-provider support, sanctions, licensing, regulatory, language, transfer, representative, filing, security, or commercial requirements. Some countries may be unavailable.

A user must not provide a false country, use technical means to evade a restriction, or purchase for a person in an unavailable country. Availability does not remove any mandatory right applicable to a lawful transaction.

7. Plans and platform differences

7.1 Android Free plan

The Android application may offer an advertising-supported Free plan with 20 credits renewed daily. The Free plan currently uses non-personalized AdMob advertising. Free credits do not accumulate as paid property, cannot be transferred or redeemed for money, and are subject to the current daily balance and service rules.

7.2 Web access

The web application does not provide the equivalent 20-daily-credit Free plan because it is not financed by advertising. Paid access is required for paid learning usage on the web, except for any expressly identified public information or limited demonstration that does not grant the Android Free-plan entitlement.

7.3 Paid plans

The current paid plan families are Starter, Professional, and Exam Intensive. They provide plan-specific monthly credit allowances, feature access, booster limits, and rollover rules. Paid plans are ad-free.

The checkout and plan page display the active plan, platform, billing interval, price, currency, taxes, recurring amount, renewal information, available features, and applicable limits before purchase. Live provider information controls over an outdated description, subject to mandatory rights and the rule against an undisclosed detrimental change.

7.4 Boosters

Paid-plan users may be offered one-time boosters containing 150, 350, or 800 credits. Current booster lots do not expire. Booster purchases remain subject to the applicable holding cap, provider availability, refund rules, and account status. A user may be prevented from buying a booster that cannot be held under the current plan.

8. Credits

Credits are limited contractual units used to access specified service processing. They are not money, electronic money, stored value, a security, a transferable asset, or a promise of cash redemption. A credit has no value outside TheLevel4.app.

The service may maintain different credit pools, including Free, subscription, rollover, booster, achievement, administrative, or promotional credits. The server-authoritative ledger controls the balance and spending order. The service may correct a duplicated, fraudulent, reversed, refunded, expired, or technically erroneous credit entry.

A credit is consumed when the applicable protected service operation is validly started or supplied under the displayed rule. A verified failed attempt may result in restoration. Leaving a successfully started exercise, failing to complete it within the available resume period, or disliking a valid AI result does not necessarily restore a credit.

9. Prices, billing, and renewal

Prices are not fixed in these Terms. Paddle or Google Play displays the applicable price, currency, tax, billing interval, and recurring amount before the user confirms a purchase.

A subscription renews automatically at the displayed interval until cancelled, ended, or otherwise changed under provider rules. Before purchase, the user must receive clear recurring terms and affirmatively confirm the transaction. The provider supplies the transaction receipt or invoice and processes the payment.

TheLevel4.app does not store a complete payment-card number. Provider records and verified server events control whether a paid entitlement is granted, renewed, cancelled, expired, refunded, or revoked. Client-side display or a payment screenshot does not create an entitlement.

10. Cancellation, withdrawal, and refunds

A user can cancel a subscription through the applicable provider-management route. Cancellation stops future renewal and normally leaves access active through the paid period. Cancellation alone does not return an earlier payment.

Withdrawal and refund rights, request channels, provider routing, timing, credit consequences, mandatory country periods, and remedies for duplicate, unauthorized, defective, unavailable, or nonconforming transactions are described in the Refund and Withdrawal Policy, which forms part of these Terms.

Where the applicable EEA or United Kingdom consumer regime, mandatory local law, or the payment provider's rules grant a withdrawal or refund right, that right applies as described in the Policy. Rules offering greater protection prevail.

11. Upgrades and downgrades

Paddle upgrades take effect immediately with the provider's configured immediate proration. Paddle downgrades apply the lower service entitlement immediately. A same-interval downgrade may apply a prorated billing credit at the next renewal; a billing-interval change applies the new recurring price at renewal without an immediate bill.

Google Play controls Android plan-change charging, proration, replacement, and effective date. The provider confirmation shown before the change supplies the transaction details. TheLevel4.app applies service-side changes after verification.

12. Acceptable use

A user must not:

13. User submissions

The user retains rights in original content they lawfully submit. The user grants the operator a limited, worldwide, non-exclusive licence to host, reproduce, transmit, transform, and process that content only as reasonably necessary to provide, secure, support, and improve the requested service, comply with law, and handle disputes under the Privacy Policy.

The user represents that they have the rights and authority necessary to submit the content. The service is designed for the user's own practice recordings, not covert recording, surveillance, or third-party biometric analysis.

14. TheLevel4.app content and intellectual property

The service, software, design, exercises, prompts, simulations, databases, branding, documentation, and original content are owned by the operator or licensed to the operator and are protected by applicable intellectual-property laws.

Subject to these Terms and the applicable plan, the user receives a limited, personal, non-exclusive, non-transferable, revocable right to access the service for individual learning and practice. No ownership is transferred. Mandatory rights to use or inspect software are not excluded where they cannot lawfully be waived.

15. Feedback

If a user voluntarily provides a suggestion about the service, the operator may use it without payment or confidentiality obligation, provided that personal data remains subject to the Privacy Policy. This does not transfer ownership of unrelated user content.

16. Service availability and changes

We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, security events, provider outages, model changes, network conditions, legal restrictions, or technical failures may affect access.

We may add, remove, or modify features, models, exercises, plans, limits, or platform availability. A material detrimental change to a paid subscription is communicated in advance where required and does not remove cancellation, refund, or other mandatory remedies. We do not retroactively change the provider price accepted for an already completed transaction.

17. Suspension and termination

We may restrict or suspend access where reasonably necessary to protect an account or the service, investigate fraud or abuse, comply with law or provider requirements, prevent harm, or address a material breach. Where appropriate, we provide notice and an opportunity to correct the issue.

We may terminate an account for a serious or repeated breach, fraud, unlawful activity, security attack, payment reversal, or continued use in an unavailable country. Suspension or termination does not remove mandatory refund or consumer rights.

A user may stop using the service, cancel the applicable subscription, and request account deletion. Account deletion prerequisites and retained legal residue are described in the Privacy Policy.

18. Privacy

The Privacy Policy explains personal-data categories, purposes, legal grounds, voice and AI processing, providers, international transfers, retention, deletion, security, and rights. Terms acceptance is not consent to optional Analytics, personalized advertising, or marketing.

19. Third-party services

The service depends on third-party infrastructure and payment providers, including Google services, Paddle, Google Play, configurable OpenAI Whisper, Brevo, and Gmail. Their own terms may apply to their independent services. A link or integration does not make the operator responsible for an independent provider's service beyond responsibilities that cannot lawfully be excluded.

20. Disclaimers

To the maximum extent permitted by law, the service is provided on an “as available” basis. We do not guarantee that an AI result, transcript, score, explanation, exercise, or learning recommendation is accurate, complete, current, suitable for a particular examination, or accepted by an employer or authority.

Nothing in these Terms excludes a statutory guarantee, duty, or remedy that cannot lawfully be excluded. In particular, these disclaimers do not remove rights concerning defective, unavailable, unsafe, misrepresented, or nonconforming digital services.

21. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including applicable liability for fraud, wilful misconduct, gross negligence, death or personal injury, breach of non-excludable consumer guarantees, or other mandatory responsibility.

Subject to those mandatory rules, the operator is not responsible for indirect, incidental, special, or consequential loss that was not reasonably foreseeable when the agreement was made, or for loss caused by unauthorized use, user-supplied unlawful content, reliance during prohibited real-world aviation operations, or an event outside reasonable control.

Any permitted financial limitation must be interpreted narrowly and cannot reduce the minimum remedy required by the law applicable to the consumer. No limitation applies more broadly than the law permits.

22. User responsibility for claims

A user is responsible for reasonably foreseeable loss caused by their unlawful content, fraud, deliberate security attack, infringement of another person's rights, or material breach of these Terms. This clause does not impose an indemnity or shift costs to a consumer where doing so would be unfair or unlawful.

23. Governing law and courts

These Terms are governed by the laws of Bolivia. The competent courts of Cochabamba, Bolivia have jurisdiction, except that this choice does not deprive a consumer of non-waivable protections, jurisdiction, venue, or remedies available under the law of the consumer's habitual residence.

There is no mandatory arbitration agreement. The parties may voluntarily attempt to resolve a dispute through support, direct negotiation, mediation, an applicable consumer authority, or another lawful route before or during court proceedings.

24. Mandatory local rights

Nothing in these Terms limits or waives a mandatory consumer right, statutory guarantee, withdrawal, cancellation, refund, complaint, privacy, jurisdiction, venue, language, or remedy that cannot lawfully be waived. If these Terms conflict with a mandatory local rule, the mandatory rule controls to the extent of the conflict.

Approved regional schedules and translations form part of these Terms for the relevant jurisdiction. They add local requirements without reducing the global protections stated here.

24.1 Qatar

Where Qatar consumer law applies, information that the law requires to be provided in Arabic—including applicable service, price, subscription, cancellation, and refund information—is provided in Arabic. English may accompany it. The Arabic information controls to the extent required by law.

A consumer who concludes a contract through electronic communications may rescind or terminate it within three days after conclusion where, and only to the extent that, the conditions established by applicable Qatar law are satisfied, including that the service has not been fully performed in a manner serving the purpose of the contract and the consumer has not used or obtained benefit or material value from it. Instructions for exercising this right appear in the Refund and Withdrawal Policy.

TheLevel4.app remains responsible for mandatory remedies where the service is defective, materially nonconforming, or not supplied as described. Depending on the circumstances and applicable law, the remedy may include correct re-performance, restoration of affected credits, or a refund. Nothing in these Terms excludes compensation or another consumer remedy that cannot lawfully be waived under Qatar law.

25. Notices and support

Routine purchase, payment, renewal, failed-payment, cancellation, refund-payment, tax, and invoice communications are generally provided by Paddle or Google Play. TheLevel4.app provides required case acknowledgements and decisions, operator-controlled material change notices, and any country-specific notice not verified as sufficiently provided by the payment provider.

Electronic notices may be provided through the registered email address, in-app display, account page, provider channel, or public website where legally sufficient. Users must keep their contact information current.

26. Changes to these Terms

Each version identifies its version and effective date. We may update these Terms for service, provider, security, business, or legal changes. Material changes are notified in advance where required. Renewed acceptance is requested when the nature of the change or applicable law requires it.

A change does not retroactively remove an accrued mandatory right. If a user rejects a future material change, the available remedy may be to stop using the affected service and cancel before the change takes effect, subject to mandatory rights.

27. General provisions

If a provision is invalid or unenforceable, it is limited or removed only to the minimum extent necessary, and the remaining provisions continue. A failure to enforce a provision once is not a permanent waiver. The user may not transfer the account or agreement without permission, except where a mandatory right permits it.

These Terms, the Privacy Policy, the Refund and Withdrawal Policy, the checkout disclosures, and any applicable approved regional schedule form the service agreement. Paddle or Google Play terms separately govern their purchase transaction.

28. Language

Approved translations may be made available through the same stable Terms link. The English version is the master drafting version. A local-language version controls where mandatory law requires it; otherwise, English governs to the extent permitted by law.

Where Qatar law applies, required Arabic consumer and pre-contract information forms part of the applicable service presentation. English may accompany, but does not replace, information that the law requires to be provided in Arabic.
